Roshni act decision challenged
Many petitioners have gone to Supreme Court of India against the recent decision of JK high court calling the act as illegal and unconstitutional while ordering a CBI probe into this entire scam.
The petitioners have told the Supreme Court that the JK high court decision was wrong in the light of laws and they have not been heard while the orders have been passed for their eviction.
solicitor general who appeared on behalf of the government told Supreme Court that already JK administration has filed a review petition in JK high court not only asking for the time to put in place a mechanism for the implementation of its orders but also has asked the court to distinguish between the land grabbers and the common people who were benefited by this scheme of JK government.
He sought one week’s time from the Supreme Court to respond to all those appeals which are pending before it from the petitioners of Jammu and Kashmir.
It is already known that JK high will listen to the review petitions on December 21, and the Supreme Court said that two parallel could not be conducted in the courts in this matter and asked the high court of Jammu and Kashmir to decide on this matter as the case is listed on December 21.
The Supreme Court observed that the Union Territory administration of Jammu and Kashmir has also filed a review petition and it has divided land owners in two categories – illegal encroachers and real owners.
